Private Prosecutor per Rule 7:8-7(b): What recourse do you have if you report a traffic violation or a minor criminal offense and the authorities decide not to files charges? Or worse, what recourse do you have if you are the victim and the authorities decide not to file charges? Answer: You have the right to swear out an Affidavit of Probable Cause, file charges yourself, and prosecute on your own. In this scenario, you become in effect "the State," and must prove the charge beyond a reasonable doubt. Would you know how to do this?
